If a debt settlement plan does not work for you and you can not pay your debts then bankruptcy is the alternative.  You can file bankruptcy on your own without an attorney but it is very complex and likely to be dismissed by the judge if you make mistakes.  You really need the help of an attorney that specializes in bankruptcy.

There are two types of bankruptcy for individuals, Chapter 13 and Chapter 7.

Chapter 13:Rehabilitation with a payment plan for individuals with a regular source of income; enables individuals with regular income to develop a plan to repay all or part of their debts; also known as Wage Earner Bankruptcy.  With a Chapter 13 you pay you debts with a court approved plan.

Chapter 7: Basic liquidation for individuals and businesses; also known as straight bankruptcy; it is the simplest and quickest form of bankruptcy available
